Car Accident step by step Part 13: What you injury is worth




According to the Colorado Department of Motor Vehicles injury damages are split into three categories:





  1. Economic Damages:  These are your medical bills, lost wages (both present and future) and general "real" expenses.
  2. Non-Economic Damages:  These are the "what-if's" you may experience from a car accident.  Other things that fall into this category are pain and suffering, loss of quality of life and emotional distress.
  3. Physical Disfigurement and Impairment:  Consequences and costs of irreparable physical harm or permanent disability.
Let's look at the Economic Damages:  This is simple.  Your medical bills are your medical bills, your lost wages are your lost wages and all other expenses are just that.  Simple.

Non-Economic Damages are where the insurance companies love to muddy the water.  This is when you need an Attorney!  The insurance company is not going to agree to the loss of quality of life because they don't want to believe you have one.  The insurance company is not going to believe you have any pain and suffering because you are seeing a Doctor that they are paying for.  And emotional distress....they are just going to tell you to get over it.

Physical Disfigurement and Impairment is another way insurance companies will tell you that you are worth less than you are.  If you need surgery it's covered under Economic Damages....but what about the scar that it leaves?

When you are involved in a car accident you need to hire an Attorney who KNOWS what you are worth and will fight for it.

Car Accident step by step guide Part 2: watch your words

You are driving down the street and the next thing you know you are face in your airbag.  You've been hit by someone.  You don't know what happened.  What should you do?

Keep your mouth shut!!
"Insurance companies didn't get to be $15 billion and $20 billion (companies) because they give money away," says John Smith of Morgan Hubble Smith Insurance, based in Columbus, Ohio.
What happened? Is usually the first question asked by the first responders; police, fire department, paramedics, EMT's, witnesses to the accident, etc.  What you say can be twisted to whatever the insurance company wants, remember they didn't get to be a $15 billion dollar company because they want to take care of you!

No matter what the situation is.....keep your mouth shut.  When the adjuster comes out...keep your mouth shut.  They are looking for "key" words or phrases that can and will be used against you.  Don't discuss anything personal: "I just lost my job" or "I just broke up with....." NOTHING!!

Car accidents are a very stressful situation to be in.  It is natural to "talk" because you are nervous.  But....you don't want what you say to hurt your claim and, trust me, if they can manipulate what is said, to their advantage, they will.

Don't apologize...this can be construed as an admission of guilt.  I have been in two car accidents, neither of which was my fault, and I can tell you...the first thing out of my mouth on the first one was "I'm sorry" meaning just that...not that I was guilty but I was sorry the accident happened.  That was a hurdle that we should not have had to jump through....but it did teach me for the car accident that happened later.  

So, what can you do? 

  • Get to a safe place
  • Make sure everyone is okay
  • Call the police and, if needed, an ambulance
  • Have your driver's license, registration, and auto insurance (Everything they need to know about you is on these items)
  • SAY NOTHING!!!
  • Call an Attorney
Learn from other's mistakes!

Labor Day: Don't drink and drive






How many drinks would it take to be considered drunk? Too drunk to drive? Have you ever wondered....okay have you ever wondered this BEFORE you started drinking and not after?





Okay, one (1) drink per hour is a safe calculation.....it's too hot after that long.

Here is a calculator that tells you (estimate) what your BAC (Blood Alcohol Count) would be after so many drinks in so many hours.....COOL!! BUT.....I just learned that if I have four (4) beers at 6% alcohol in 2 1/12 hours oops DUI. This shocked me because when I have four (4) beers at 6% alcohol in 2 1/2 hours I FEEL FINE....I guess that's where the impairment comes in huh?

So here's the thing. No one wants you to drive drunk or impaired....even bar owners. If you aren't safe you won't return, am I right? It used to be called a $10,000 DUI...well those days are over because the with the increase of insurance, legal fees, fines, bail it could be up to $25,000 when you are finished.....that is $6250.00 PER BEER I just had. MSN has a breakdown of most fees that may be incurred with a DUI. (MSN Money arrive alive).

It is important that if you are going to be drinking please do not drive. Get a designated driver, call a cab or call a friend (hopefully not the friend who was sitting next to you drinking with you). I am going to have to call someone or have a designated driver as the calculator says I am allowed two (2) beers at 6% alcohol in a 2 1/2 hour time span.

Labor Day is a great day to celebrate...just do it safe!!

When you don't watch for motorcycles people can die

This week is being dedicated to motorcycle safety as we are currently in Sturgis week 2012. 






Let me explain to those of you who do not understand motorcycles.....just because they can go faster, maneuver easier does not mean they can avoid YOU if you don't see them.  They are trusting each and every person driving four plus wheels to be paying attention to what is around you.  Honestly, when you are driving you should always be doing this anyway...but those on bikes are trusting YOU with THEIR lives.

I have written about distracted drivers and how quickly it can go from bad to worse.  Take that text you send to tell your friend you are five minutes away.....going 55 miles per hour you will travel the length of a football field. 

According to the Colorado Department of Transportation in 2010 1 in 5 traffic fatalities were motorcyclists.  I know there are arguements that these numbers are high because Colorado does not have mandatory helmet laws.  There are pros and cons about this law but that is not what I want to focus on....I want to focus on if you are watching for motorcycles and you are paying attention YOUR actions will not cause an accident.  Those of us who ride motorcycles take a higher risk of injury because we are on two wheels, we have less protection than you do in your vehicles and it is harder to see us IF YOU AREN'T paying attention and looking over your shoulder when you change lanes.  (This should be common practice no matter what.)


Yes, more often than not, motorcycle accidents happen to the "less experienced" riders than the one's who have been riding forever BUT we all started out as inexperienced drivers at one time or another no matter what we drove and no matter if they have only one year experience or 40 years experience riding a motorcyle their lives are precious to someone and no one should be hurt or lose their lives because of a distracted driver....no matter what they drive.

If each person who gets behind the wheel of a car, truck, semi and, yes even a motorcycle pay attention to their surroundings we can all be safer.

The unspoken injury of car accidents

We all know the common injuries from a car accident; back, neck, broken bones, etc....what we don't often know about, realize or talk about is the injury that happens to a marriage after the car accident.

Car accident injuries can last a long time.  At first the spouse is understanding, caring and willing to do everything while you recover.

When the stress of your injuries, stress of loss of income, stress of medical bills, stress of "doing it all" will eventually cause problems in a marriage.

It is hard for the healthy spouse to do everything.  It is even harder for the injured spouse who is used to doing things...watching others take care of them.

It is hard for the healthy spouse to take the children to all their school events, recreational events, appointments.  It is even harder for the injured spouse to miss these events.

Resentment begins to build from both spouses.....the healthy one resents the injured one because they have to "do it all" and the injured one resents the healthy one because they can do it all.

In my personal experience my husband was very caring.......in the beginning.  Then he became very resentful.  Then he started to tell me to quit "exaggerating" my injuries.  Then he went from not believing I was ever hurt...I just wanted to lie around for eight months.  The he went OUT THE DOOR.

There is a saying "Your friends know you when times are good, You know your friends are when times are bad."  I guess this will work in a marriage also.

The worst thing that you can do is stop communicating with each other and start complaining to others.  If you are the healthy spouse try to understand that the injured spouse has to deal with the PAIN of the accident and deal with the inability to help out after the accident.  If you are the injured spouse understand that the feelings of the healthy spouse is normal.  Talk, communicate and be there for each other.

PTSD after car accidents

Post-Traumatic Stress Disorder is more than just returning soldiers.  According to PTSD Support Car Accidents are the Leadin Cause for PTSD in the General Population.

This News release also goes on to say that OVER three million people a year are involved in car accidents which cause serious bodily injury and psychological distress.  10-45 PERCENT of those injured later suffer from PTSD!!

It makes sense:  Car accidents cause TRAUMA which is the most frequent kind of trauma experienced by American men and the second most experienced by American women.

Let's go through the sequence of events when involved in a car accident:

  • Parties involved check for injuries if able.
  • 911 is called
  • Police and Emergency Responders show up
  • Go see a Doctor (whether it be by ambulance from the scene of the accident or later)
  • Physical injuries are treated
Now let's go through what happens after the physical injuries are treated:
  • Fear of driving or riding as a passenger
  • As most accidents happen close to home driving by the scene of the accident is a constant reminder
  • The simple task of daily driving is changed
If you do not have a person in your life that can recognize the signs and symptoms of PTSD or Depression it will progress into something that is harder to treat.

Doctors, Chiropractors, Attorney's and all care Physicians need to recognize the signs and symptoms to help before it gets too out of control.

Signs to look out for are
  1. Depression.  Watch and listen for signs, "you wouldn't understand" start to think about the value of their life, possible abuse of drugs and/or alcohol.
  2. Isolation:  If you find them not doing the "things they used to do" with their friends, family, etc. or they become distant from everyone.
  3. Rage:  If they strike out for no reason, or little reason and it happens with increased frequency.
  4. Avoidance of Feelings: Alienation of family friends.  Cannot appreciate the joys in life.
These are just a few but if you or a loved one has been involved in a car accident TALK TO YOUR DOCTOR before you feel any of these symptoms so you are both prepared if it should happen.

Texting and Driving

Can anyone really ever say they have NEVER texted while driving....or read a text while driving?  Okay, those who do not have cell phones can say they never have.  Those who do not have text messaging on their cell phones can say they never have...but for the rest of us....we would have to answer that question with "yes." 

My friend and I did an experiment the other day.  I do not recommend it but I went out on a road with no traffic so if I caused a car accident we would have been the only ones hurt.

I marked off a three mile stretch...there were a few curves (not sharp curves) that I was testing my theory on.  When I approached my beginning mark I opened a text message on my phone that said, "You are an idiot for doing this."  Now go back and time yourself on how long it took you to read that phrase.  I took me about 10 seconds to get to the text message app on my phone, three seconds to read it and two seconds to place the phone back down.  In that time I went about 130 yards, crossed the white line seven times and almost missed a small curve.

Now, I tested it with a response to the text message.  My friend texted me at the starting point and opened the text and read "are we really doing this?"  I responded back with "yes."  This time I went over 200 yards, crossed into the OTHER LANE once, crossed the white line 14 times and hit the dirt on the outside of the road three times. 

Okay, no one was hurt...
No one else was on the road...
I only text and drive when it's "safe"...

Here's the thing...texting and driving is only safe when YOU are the only factor.  It reminds me of driving on icy roads...I know how to do it but not everyone on the road does.  What if on one of the times I drove on the dirt on the outside of the road a child riding a bike rode up at that same time?  What if one of the times I crossed the white line a deer ran out in front of my car?  What if the one time I ended up in the other lane a car was waiting at the stop sign and turned right into me? 

The fact is WE NEVER KNOW what other factors are out there waiting to impact our lives.  What other factors are out there that our texting and driving can impact their lives?

The simple TRUTH is JUST DON'T TEXT AND DRIVE.  We lived MANY, MANY, MANY years without the technology of texting and no life will ever change by WAITING until you are stopped to return a text message but many lives WILL CHANGE if you try to beat the odds by texting and driving and causing an accident.  It will change YOUR life if you cause an accident and are charged and convicted of homicide.  Don't let this happen to you or someone you love...watch this video.

It's not even the hottest month of the year yet

It's hot! And it's not even August yet!  Here are some tips to help you stay cool this summer.

  1. When your body is hot your body works hard to cool down. (One example is sweating). The one thing you want to do is drink something cold. When you do this you take your internal organs and make them cold when your external organ is hot. You do not want to take the opposing organs to this much of an extreme. When you are hot, drink something warm first: tea, coffee, etc (preferably caffeine free: see #4). This will normalize your body temperature easier. Once you have done this you can enjoy your cold beverage.
  2. I know, I know driving with the AC on full blast is nice. BUT if you are in and out of your car a lot during the day this can actually be too hard on your body. As with the cold drink, you are taking your body from one extreme to another.
  3. When it is extremely hot...you know like the weather we have had the last week and expect to have for yet another week....wet towels ARE YOUR FRIEND! A cool towel (not cold and not ice) draped around your neck will do wonders. I will also run cool water over my wrists. Avoid ICE when you are hot. Again, it is too big of an extreme and you won't feel any cooler using ice vs. cool towels.
  4. NO SODA, yes this means pop! Soda causes dehydration. Okay study shows caffeine and sugar will cause dehydration. Don't believe me....try it. On a hot day drink a soda. 15 minutes later you will be thirsty if not immediately afterwards. If you are thirsty drink water. I love to add lime to my water. It is recommended that eight (8) glasses of water a day is needed to just to survive. This amount does not take into consideration if you exercise or the temperature. Use this calculator to determine how much water you should be drinking daily.
  5. Eat a lot of fruit. Fruit is a refreshing way for your body to get fluids that are lost through sweat.
  6. Cover your head if you plan on being outside. Hats, Hats, Hats are not just a fashion statement. Wearing a hat can help you reduce your core body temperature.
  7. Eat smaller meals. When your body digests food it it focused on digestion and will not cool your core temperature as well. Eat smaller meals more frequently.
  8. Loose, light clothing. Black absorbs the heat. Light colored clothes will keep you cooler. Wear loose clothes so your body is able to breathe.
  9. Try to do all of your running around in the morning or early evening. Temperatures are cooler at this time and you will avoid taking your body to extremes.
  10. If you must be outside freeze a soaked sponge in a sandwich bag.  When you are outside you can use this to place on your wrists or neck to get cool without the mess.

Relation to size of accident to severity of injury

Some of the "smallest" accidents can cause the biggest injuries.  It doesn't take a semi truck to hit you head on to cause serious injuries. 

How many times have you heard of a car that was totaled and the driver walked away without any injuries?  When this happens you say, "someone was very lucky."

How many times have you heard of a "fender-bender" and the driver sustained many serious injuries?  I know, when you hear of these you say, "Ya right, this person is milking the system."

Honestly, some of the "smallest" accidents can cause the biggest injuries.  I have spoken of my car accident...it was a little one....for the car that is.  For me....yes I was "looked at" as if I wasn't really hurt (and I want to add that these looks came from a DOCTOR).  It wasn't until additional tests that were run that it was discovered I really was hurt (imagine that).

What is important to know when you are involved in a car accident is that NO MATTER how LITTLE the accident was go see a DOCTOR. 

I am going to suggest something that I wish I had done when I had my car accident.  If you do not require emergency care call an Attorney first....who knew that Personal Injury Attorney's knew Doctors :)

Who knew that a Personal Injury Attorney knows about "medical stuff." 

If you do require emergency care....make sure YOU or someone you trust knows what is going on and what treatment you are being provided.  Emergency Room Doctors are NOT specialists...they are there to SAVE YOUR LIFE.  It is essential that YOU or someone you trust knows what is going on.  When you are able call an Attorney.  A good Personal Injury Attorney will take care of things for you.  Refer you to the BEST Doctors/Chiropractors for YOUR situation.

Another joke to finish the weekend....

Only those who can laugh at themselves will never be laughed at:  On that note:

Are blondes smarter than lawyers? You be the judge. A blonde and lawyer are seated next to each other on a flight from LA to NY. The lawyer asks if she would like to play a fun game. The blonde, very tired, just wants to take a nap, so she politely declines and rolls over toward the window to catch a few winks. The lawyer persists (as lawyers are wont to do) and explains that the game is easy and a lot of fun. He says, "I ask you a question, and if you don't know the answer, you pay me $5.00 and vice versa."
Again, she declines and tries to get some sleep.
The lawyer, now agitated, says, "Okay, if you don't know the answer you pay me $5.00, and if I don't know the answer, I'll pay you $500.00."
This catches the blonde's attention and, figuring there will be no end to the torment unless she plays, agrees to the game.
The lawyer asks the first question, "What's the distance from the earth to the moon?"
The blonde doesn't say a word, reaches in her purse, pulls out a $5 bill and hands it to the lawyer.
"Okay," says the lawyer, "your turn."
She asks the lawyer, "What goes up a hill with three legs and comes down with four legs?"
The lawyer, puzzled, takes out his laptop computer and searches all his references, no answer. He taps into the air phone with his modem and searches the net and Library of Congress, still no answer. Frustrated, he sends e-mail to all his friends and coworkers, all to no avail. After an hour, he wakes the blonde and hands her $500.
The blonde says, "Thank you," and turns back to get some more sleep.
The lawyer, more than a little miffed, wakes the blonde and asks, "Well, what's the answer?"
Without a word, the blonde reaches in her purse, hands the lawyer $5.00, and goes back to sleep.

Finding an Attorney

It's all about Feeling the Rain

Attorney, Lawyer No matter what you look up in the phone book there are a "million" out there! 

As Bob Marley hinted to:  FEEL the rain...
 don't just get wet!!!



Finding the right Attorney for you is "Feeling the Rain".  Others will just allow you to get wet!


I'm off to pick the perfect Apple off the tree.  The bottom branches have dropped some pretty bruised Apples.  The low hanging branches have some "okay" looking Apples.....but I extend my search and find some great Apples a little higher up.

Same thing goes for finding the "right" Attorney for you.  There are the one's on the ground....not saying they aren't a good Attorney but are they a good Attorney for YOU!!

Do some research!  Ask questions!  Ask people you trust!  If you take the time to search for that GREAT APPLE it will be worth the time spent finding it!!!

The Lighter Side of Lawyers...Joke of the Day

This has been around a bit but it is so funny it needed to be said again.

All the Truth and nothing but the truth

In a small village court the lawyer for the prosecution called his first witness. A very old lady and grandmother stood in place and the lawyer began to ask:

"Mrs. White do you know me?"
She answered:
"Of course, I know you. I know you since you were a little boy and frankly you have undeceive me. You have always been blatantly, you cheated on your wife, manipulate people and badly discourse them when they leave. You think you're a great personality when you do not even have enough intelligence to avoid being scanned. Of course I know you."

The lawyer was white not knowing what to do. After thinking for a while he pointed to the other end of the room and asked:

"Mrs. White do you know the defense attorney?"

The old lady responds rigth away:
"Absolutely. I also know him since his childhood. He is a looser, has problems with drink and can not have a normal relationship with anyone, and as a lawyer... He is the worst one I have seen in my entire life. I also want to mention that he fools his wife with three different women, one of which, curiously, is your wife. Yes, I know him too. Absolutely."

The defender was in shock. The judge then asked both the lawyers to get closer to the bench and with a very weak voice he said to them:

"If any of you two happen to ask the old goat if she knows me, I swear I´ll put you both in jail!"

Attorney's are like fruit:  Some are good and some are bad. 

You just need to know how to pick 'em.

Statistics from 2008 show that car accidents are highest during Fourth of July!  Yes, they are higher than New Years Eve!  According to Fox News and the National Traffic Highway Safety Administration 51% die from alcohol related accidents.  WOW!  That is crazy!!  I guess it makes sense....it's hot, people drink, it's a holiday.

Summer car accidents are increasing

We all hear about car accidents in the winter with ice, snow and low visability.  But car accidents are on the rise in the summer.  Summer is when are kids are out of school and...on the road.

With the heat we have been having heat exhaustion is a big problem.  According to WebMD Heat exhaustion is a heat-related illness that may occur after you've been exposed to high temperatures for several days and have developed dehydration, which is an inadequate or imbalanced replacement of the fluids and electrolytes you've lost through excessive perspiration.
There are two types of heat exhaustion:
  • Water depletion. Signs include excessive thirst, weakness, headache, and even loss of consciousness.
  • Salt depletion. Signs include nausea and vomiting, frequent muscle cramps, and dizziness.

Symptoms of Heat Exhaustion

The most common signs and symptoms of heat exhaustion include:
  • confusion
  • dark-colored urine (which indicates dehydration)
  • dizziness
  • fainting
  • fatigue
  • headache
  • muscle cramps
  • nausea
  • pale skin
  • profuse sweating
  • rapid heartbeat
Take a good look at the list of symptoms of heat exhaustion.  Now imagine having these symptoms while driving....it is a dangerous combination.

Whiplash

Whiplash is an injury that can be caused by a car accident.  There may be minimal or no damage done to your vehicle which will lead the insurance companies to claim that you were not injured in the accident.  Also, you may not know you are injured for weeks after the accident.  I know this first hand from my car accident.  It wasn't until a few weeks after my accident, and after I told the other party's insurance company I was not hurt, that I could barely move.  After months of doctor visits I learned of my neck injuries.
