The Good In Attorneys

WOW!  Want to hear a quick, funny joke....many can be found about Attorneys.


What is 1000 Attorneys at the the bottom of the ocean?  
A good start.

We can all get a good chuckle at these jokes but for those of us who have ever NEEDED an Attorney and found a good one they are just that.....a joke.  I can laugh at most jokes that don't hurt a person.  I share jokes about Attorneys, Insurance Agents, Football teams...they are fun.

I want to look at a different side of Attorneys:  The Good Side.

As with ANY profession you will find the bad with the good.  As with ANY Attorneys you will find the bad with the good.

I have found you can determine a good Attorney by asking a few questions:
  1. What do you do for a living?      I help people.
  2. Why did you choose to be an Attorney?    To help people.
  3. If you could do anything else what would it be?    I wouldn't because I love to help to help people and found this is the best way I can.
It's simple:  Those who become Attorneys for the "status" for the "pay" for the "Esq." behind their name....well, I don't want to say they are not all bad Attorneys, as they may be excellent Attorneys, BUT what drives them is what concerns me.  

I want an Attorney that WANTS to be my Attorney.  
I want an Attorney that sees the injustice of what happened and WANTS to make it right.
I want an Attorney that WANTS to get to know me...not just my case.

I am fortunate, in my line of work, I have met many Attorneys....some Excellent and some...not so much.  The excellent ones I have met all have the same "thread" that hold them to their career.  That thread is integrity, honesty and knowing their clients. It is the personal challenge they give themselves that make them stand out....the challenge is not for the "win" but for the client and when the challenge is for the client, more often than not, they are going to win.

What does Christmas mean?




What does Christmas mean?  Presents?  Family?   Click HERE and listen while reading

I'll never forget Christmas growing up.  I know everyone says that.......but times are different now.




I remember growing up and getting so excited for Christmas.  I would have my list of what I wanted ready before Thanksgiving.  Christmas morning was the best day.  As I opened my presents I'd hear;

"I hope you appreciate what you have, there are some children who have nothing."

I didn't get it.

As I entered into high school my list, let's just say it didn't get bigger unless you are talking about the price tag.  Although I didn't tear into the presents like I did as a child it still was the best day.  Again, I would hear;

 "I hope you appreciate what you have, there are some children who have nothing."

I didn't get it.

I entered into young adulthood.  I have to admit that Christmas was still a great day. Some things had changed...I enjoyed giving "almost" as much as receiving. While opening my presents I'd hear;

 "I hope you appreciate what you have, there are some who have nothing."

still didn't get it.

Now that I am grown I still have my Christmas list:
  • I want ALL types of abuse to stop; both human and animal.
  • I want ALL types of neglect to stop; both human and animal.
  • I want ALL types of homelessness to stop; both human and animal.
  • I want ALL types of suffering to stop; both human and animal.
  • I want ALL types of hate to stop; both human and animal.
  • I want ALL types of hunger to stop; both human and animal.
This is the same Christmas list I have had since I finally “got it” but this Christmas list seems to be the one I didn’t get.

I would give back every toy I have ever received, I would give back every sweater I have ever received, and I would give back every Christmas present I have ever unwrapped if I could just GET IT this year.

It is amazing how our needs change as we grow. 

I finally GET IT!

Being honest with your Doctor


Attorney's can only fight for you if they know the truth.  They need documentation from your Doctor to fight so you need to tell your Doctor everything. 


When you are involved in a car accident there are many spokes on the wheel that moves forward to help you recover and receive the compensation you deserve. 


I have written about what you should tell your Attorney when you are involved in a car accident.  We are going to talk about what you should tell your Doctor.  

Don't "hide" anything from your Doctor.  What they don't know can come back and hurt you.

1.   Previous injuries:  You may not think it is important to tell your Doctor that you were in a car accident 10 years ago because your injuries are healed BUT if they are not aware of your past injuries than they can't diagnosis you and decide a proper treatment for you.    
2.   Injuries since the accident:  If you are injured after your car accident you do not want that to cause problems for your current case.  Let your Doctor know of all injuries you sustain after the car accident so they can adjust your treatment.
3.   How's your marriage?  Are you divorced or getting divorced? Your emotional frame of mind will be a factor on your healing process.  Depression is common after injuries.  Your Doctor needs to know your emotional state to work on your physical state.


In order for Insurance Companies (no matter how you were injured) to avoid paying you...they have to find reasons not to.  Don't let any of those reasons be something that could have been avoided had you been honest and forthcoming with your Doctor.  And, don't think that your history cannot be discovered because to avoid paying your settlements Insurance Companies DO THEIR RESEARCH!!  

Let’s be honest….to everyone who is attached to your injury. This includes your Doctor, your Attorney, your family…everyone.  You cannot heal until your Doctor knows what to help with.  You cannot move forward until you are honest. 

Let’s talk about prescription drugs, non-prescription drugs, smoking and alcohol intake.  You may think keeping those secrets from your Doctor is a wise move BUT your health and your life may be determined by your secret.  Doctors prescribed what they do; medications, physical therapy, etc. by what they know…they only know what you tell them.  Tell them everything even if it means getting a lecture about it.  Your life depends on it!

Traveling this Thanksgiving

Let's be honest.  Thanksgiving, although it is the holiday for giving thanks, brings much stress that we could all use less of.

You pack the kids up, you grab the dish you prepared and you hit the road.  Earlier I wrote about how Thanksgiving is the deadliest of holidays in respect to car accidents.  If you missed it you can read it HERE.  

I want to talk about what you can do to avoid car accidents whether it is on Thanksgiving or any day.

Seat belts, Seat belts, Seat belts.  The best offense is a good defense.  When looking at the statistics for deaths on Thanksgiving not all of them are caused by the driver who is killed.  The other drivers on the road always have been and always will be one of the most non-controllable dangerous aspects of driving.  Buckle up!!

Distracted Drivers.  Keep your eyes on the road.  Here is another non-controllable aspect of other drivers BUT you can control whether you are distracted.  Put your cell phones down, don't play with the radio and pay attention!

Aggressive Driving.  Stress.  This will cause many things.  Running late and speeding, spending the day with family, "Are we there yet" from the kids every five minutes.  All these things will tend to cause a person to drive aggressively.  This is another thing you can control while you drive but pay attention to other drivers!

We cannot control everything but what we can control is WHAT WE DO!  

Buckle up
Pay Attention
Drive safe and within the speed limit
DON'T drink and drive

Remember this holiday is to reflect what we are thankful for.  
  • Be thankful that you have family you can spend this day with.
  • Be thankful that you can share a meal with family as some go hungry.
  • Be thankful that you have a vehicle to travel in.
  • Be thankful that you do not have to work.
  • Be thankful you have a job.
No matter what you are thankful for....please drive safe and pay attention.  Your life, the life of a loved one or the life of a stranger depends on YOU!!

Thanksgiving ranks as most dangerous holiday to drive


I would have thought that this title would belong to New Years Eve and Day because of the drinking aspect of the holiday.  I was shocked to learn that Thanksgiving is the deadliest holiday we have in respect to car accidents.

Thanksgiving is right around the corner so if you plan on traveling or if you have those traveling to your house you need to read this.




Here's the reason why:  Information provided by RITA: Research and Innovative Technology Administration of the Department of Transportation.
  • An estimated 91% of Americans will travel by car to reach their destination Thanksgiving
  • The number of Americans on a road trip longer than 50 miles increases by 54%
Thanksgiving is a "short" holiday which will increase the speed travelers use to get to their destination.  We have more people ON the road and more people speeding to their destination.  

We also need to look at the road rage that happen with more people on the road. More aggressive drivers, in a rush to get to their destination is a deadly combination.

According to Forbes.com:

Thanksgiving Day
Number of Fatalities in 2008: 502
Average Number of Fatalities Per Year Since 1982: 567
Average Percentage of Alcohol-Related Fatalities Since 1982: 41%

Looking at these statistics alcohol related fatalities, during the four day Thanksgiving holiday, a little less than half of the deaths. Looking at the holidays to choose from alcohol related deaths would seem to belong to New Years. Maybe people who go out drinking on New Year's Eve are getting smarter about responsible drinking but seem to forget this over Thanksgiving. 

I couldn't "figure" out why so many drink on Thanksgiving then I remembered the Bowl games.  Big weekend for college football.  This explains a little bit of the drinking on this holiday.

Gas prices have always been a determining factor on how many people are on the road over the holidays.  If gas prices are high than people will "reconsider" driving long distances to see family that they will see again over Christmas.  

No matter what the reasons are you need to be aware that Thanksgiving day is a dangerous day to be on the road so if you plan to travel...travel safe, watch your speed and please do not drink and drive.

Holiday traditions

What is your holiday tradition?

We are entering the 2012 Holiday season and I'm still living in the summer.  Where did the time go?  

We have Thanksgiving, Christmas and New Years quickly approaching.  We grow up doing holiday traditions one way, we become adults, get married and now what?  We have two people who have celebrated the holidays their entire lives one way and now you have to figure out what to do.  Who gets Thanksgiving, Christmas....and how do you work this so no one is left out or offended.

Do your families help with making this decision or do they put pressure on you to keep your tradition?

Do you alternate years on how you spend the holidays?

Do you start a new tradition at your house and invite both sides?

This is supposed to be a time of cheer.  A time of Love.  A time of togetherness.  Nothing hurts togetherness like family.  I have friends whose families actually make them feel guilty if they spend the holidays with their in-laws.  I have friends whose families embrace the in-laws and combine traditions. What is the reasons for such a difference?  Is it fear of losing something?  Is it the fear of your tradition not caring on?  All traditions "change" over time.  The traditions you grew up with are not the same traditions your parents did. 


Let's look at this.  Two siblings (we are going to make it easy) grow up with one tradition.  The oldest sibling gets married. Now we have 2-4 families to decide holidays....Your mom, dad, their parents, new spouse and their parents and lets not forget any aunts, uncles, siblings, etc they may have.

Whew got that figured out.  new tradition begins.  Now the youngest sibling goes off and gets married.  Are you kidding me!  Now we have 4-8 families having to figure out what to do.

New tradition begins.  Now lets assume that these traditions are working great!  10 years down the road...oops one sibling gets divorced.  Tradition changes again.  

Remarried.  Tradition changes again.

Other sibling gets divorced.

Tradition changes again.

Remarried into a family of six siblings.  Tradition changes again.

Children of siblings grow up and move away.

Tradition changes again.

Children grow up, move away and get married.

Tradition changes again.

So my question is this:  How long does something have to happen before it can be considered a tradition?

A few chuckles for you




Just a few jokes to lighten your day:





  • A client calls up his insurance agent and tells him he needs to file a claim. The agent says “Tell me what happened?”  The client tells him and the agent says “I’m sorry but that’s not covered.” The client says “well, let me explain better what happened.” The agent says “I´m sorry but that´s not covered either.” The client says ” I´ll tell you what, you tell me what´s covered and I´ll tell you how it happened!”  (Insurance-finder.info)
  • Mr. James Barricks, was a rich old man was dying from a rare disease. On his deathbed, he called for his insurance agent, doctor and preacher:  "I trusted each you my entire life. Now I want to give each of you $30,000 cash in an envelope to put in my grave. I want to take it with me."  Mr. Barricks died and at the funeral, each one placed the envelope on top of the man, then he was laid to rest.  On the way from the funeral, in the limo, the doctor confessed "I must tell you gentlemen, I only put $20,000 on top of Mr. Barricks, I wanted buy this new machine that would enable me to diagnose his rare disease and save others. It´s what he would have wanted."  Then the preacher said: "I have to confess, I only put $10,000 on top of Mr. Barricks. We needed that money to help more homeless, and it´s what Mr. Barricks would´ve wanted” The insurance agent was angry at both men and said: "I can´t believe both of you, stealing from a dead man. I wrote Mr. Barricks a check for the full $30,000!"
  • A drunk wanders into the lounge of a hotel where an insurance convention is being held, intent on causing trouble. He yells, "I think all insurance agents are crooks, and if anyone doesn´t like it, come up and do something about it."  Immediately, a man runs up to the drunk and says, "You take that back!"  The drunk snears and replies, "Why, are you an agent?"  "No," the man replies, "I´m a crook." 
  • Two insurance salesmen were driving down a country road at high speed and passed a pickup truck with an old couple inside. "Look at those fools, pa! Must be a couple of insurance salesman and they will surely meet their maker soon, I tell you."  Well, sure enough, a little while later the couple comes across a bad accident involving the two insurance salesmen. "Well maw, we got to do what any good folk would do and give´m a decent burial." So the couple dug a hole and buried them. Just as they were putting their tools away, a cop drives up. "You folks see this accident?"  "No sir, but we knew them dang fools were going to have it when they passed us doing a hunert miles an hour. Well, we finally come across the accident and gave them insurance salesmen a decent burial"  "You were sure that they were dead??" "Well, they said they weren´t, but you know how those insurance salesmen exaggerate!"

Black Friday Shopping


Let's just start off by saying yes I am one of those crazy people who shop on Black Friday.  I wake up at 2:00 am throw sweats and a sweatshirt on and out the door I go.  

I have to say that in the past it has been better (for lack of a better word) than it has been in recent years.  It is my opinion that those of us who get up early and go shopping should get the better deals.



Last year the sales started at midnight.  Yes I know that the "really good deals" weren't offered until 4:00 or 5:00 am but it "changed" Black Friday for me.


I understand that Thanksgiving weekend is 10% of all sales for the year for retailers.  I understand they want to make a "buck."  I understand......I still do not like it.  Those of us who go shopping on Black Friday are a different breed of people.  We are insane and yes we start planning our route the minute we get the Black Friday ads.  

This is how it's been in previous years.....when I enjoyed it


Kohl's opens at 4:00 am.  Standing in line outside waiting for those doors to open is great!!  It's often cold also so we would take turns standing in line and sitting in the car with the heater going.  Inside the checkout lines are long so you have to KNOW what you want going in.  Grab and go.  It is smart to have a friend save a spot in the checkout line and you go get everything on your list (and theirs of course).  Have to be done and checked out by 4:45 am to get to the next destination.




Sears, JC Penny's and WalMart start at 5:00 am.  This takes a LOT of thought. Which store has the "I can't live without" items on it?  Where I live Sears and JC Penny's are close to each other in the same mall.  I always have to go to Sears and get my husband's items (while of course he is home sleeping).  My friend and I usually split up on this.  I go to Sears and get my list of items and hers and she goes to JC Penny's and gets hers and my list of items. Check out and meet at 5:45 am and head to WalMart.  

Once these are done we look at our other stores to shop.  What is the most important?  I always have to go to an office supply store on Black Friday to get my office supplies for the year.  LOVE THIS!!!  


I just got the "tingles" of Black Friday just writing about this (you have to be a Black Friday Freak to understand this)...then I remember....it's changed.  My friend and I went to WalMart two years ago, at midnight, got what we could (the good stuff was covered up and blocked off) and off we went. What the heck do we do until Kohl's opens up?  This took the wind right out of our sails. It is difficult to get excited about shopping when you have no where to go to do it.  Very disappointing.



So last year we are going to get that feeling back.  WalMart opened up at midnight again for their "sales" (still not the good stuff) so we are there at 1:00 am.  At 2:00 am we head out and go to another city to shop. This killed me because I believe in shopping local but we wanted that "feeling" back.  We had "fun" but it still was NOT the same.


So what are the retailers doing this year? They want to start at 8:00 PM? ARE YOU KIDDING ME!!!! What happened to tradition? For those of us who enjoyed the planning, the getting up early (or never going to sleep), the rush of "are we going to make it to the next store," and the excitement of it all.....this kills us.  WE deserve the better deals because we did get up early.  WE deserve the "early bird" deals because we are the early birds.  Call us crazy...we really are okay with that.  Call us insane because, in a way, we are.  



If you are a "true" Black Friday shopper (you know who you are) the idea of starting at 8:00 pm on Thanksgiving night has to make you angry.  

I wish, although I KNOW it would never happen, that we could all boycott the retailers this year and no one shop from Thanksgiving through the Black Friday weekend.  The retailers say they are only giving the shoppers what they want....What about what we want?  WE are the one's who have supported Black Friday for how many years?  WE are the ones who spent that 10% of what they sold annually. WHAT about what WE want?



I am going to stop my rant right here and say this:  If you are going to be out shopping this Black Friday weekend please drive safe.  I know how I drive, or used to when there were time constraints on getting to the next store, so pay attention and be safe.

Promises and fine print of Insurance Companies



You trust your Insurance Agent...I get that.  What you need to realize is that your Insurance Agent works for a LARGE Insurance Company...they do not write the policies or the fine print.  They may want to fulfill their promise to you....but the LARGE Insurance Company DOES NOT!




The free dictionary defines:

Promise:  (noun)

  1. A declaration assuring that one will or will not do something; a vow.
  2. Something promised.
  3. Indication of something favorable to come; expectation: a promise of spring in the air.
  4. Indication of future excellence or success: a player of great promise.
Prom·ised, prom·is·ing, prom·is·es (verb)
  1. To commit oneself by a promise to do or give; pledge: left but promised to return.
  2. To afford a basis for expecting: thunderclouds that promise rain.
v.intr.
  1. To make a declaration assuring that something will or will not be done.
  2. To afford a basis for expectation: an enterprise that promises well.
What is fine print in a contract?  (Arrive Alive)

"Fine print is seen as controversial because of its deceptive nature. Even though the exact terms of the agreement is “technically” available to the consumer, it often designed to be overlooked. Consumers are baffled by the technical and insurance jargon typically used in insurance policy handbooks and contracts, and have difficulty to understand these terms in plain English. When some of the content appears to be “hidden” inside the contract, this poses a risk to the consumer.
The unsuspecting customer, who can instantly see the basic aspects of the agreement, will, due to natural impulsive behavior, time constraints, and/or personal need, generally not bother to learn the caveats, instead focusing on the positives of the agreement.
It is important to note that “fine print” in a car insurance policy should not be seen as necessarily being in a smaller “font” or letter type, but it rather refers to a term or fact to be found elsewhere in the contract in an annexure or from a link to another page or sub-clause!"
So what does all this mean to you?

You get all the promises up front to take care of you should you ever get into a car accident.  As Arrive Alive states:  the fine print is hidden so you don't understand or know what you are signing.  

So many people learn about the fine print after they have been in a car accident and the Insurance Company (who PROMISED) to take care of you) uses the fine print against you.

I would say that this qualifies as an oxymoron:  Is a figure of speech that combines contradictory terms.
Or some would say a contradiction in terms:  A statement that is necessarily false.

READ the fine print.  If you have to, take it home with you so you UNDERSTAND what it means.  It is our responsibility to understand what we sign.

What not to do after a car accident

Social Networking.  What would we do without it.  Facebook, Twitter, Linkedin, MySpace and blogs.  It's the newest way to communicate.  

Although I believe nothing "personal" should ever go into any of these venues some feel it is necessary to tell the world about what is going on in their lives.  Okay that is fine unless you have been in a car accident.



Let me tell you a story about a man who was "hurt" on the job.  This was before the Facebook craze but it will give you an idea of the measures insurance companies will go to NOT to pay you.  He had been out of work, on workman's comp, for about six months.  Yes he was hurt.  On his wedding day (which was in a very public place) pictures were taken of him doing things that a "hurt" man could not do.  These pictures were used to close the case.

Now add Social Media to the "picture."  (hehe get it....picture)


You are hurt in a car accident.  You claim you are injured (not saying you are not). Facebook is NOT your friend.  I cannot tell you how many times my picture had ended up on Facebook...by total strangers (I'm in the background).  If you are dancing, snow or water skiing, lifting weights at the gym....you have just given the insurance company "proof" you are not hurt.

Let me tell you this.  I was hurt in a car accident.  I was hurt.  I had good days and I had bad days.  On those good days we want to enjoy life because those bad day are BAD.  The good days do not mean you are not hurt but if the pictures on Facebook, twitter, Linkedin, MySpace show you "not hurt" on those good days....what's the old saying, "A picture is worth a thousand words."   There are never pictures of you on these venues showing your bad days. Who wants pictures of you on the couch, right?  

If you are hurt in a car accident I strongly suggest you halt all social media.  If you cannot do that set all your setting to FRIENDS only.  Not friends of friends, not public, FRIENDS only!  Pictures are never a good idea even if your settings are friends only.  Public places are just that...PUBLIC!  Remember the story I told you about the man at his wedding?  Even on your good days don't go crazy out in public.

I know....it sounds like I'm saying do not enjoy yourself EVER.  I'm not saying that.  I'm saying anything you say or do can and will be used against you.  

Being hurt in a car accident is hard enough on us.  Don't add problems to your case that ARE avoidable!!  Don't hand the insurance company ammunition to deny your claim.

America the Beautiful: History of Veterans Day

We live in a world that either supports the war or hates the war.  People choose sides.  People talk about their views on the war.  


I want to talk about the SOLDIER not the war.  I want to talk about their sacrifice.  
You can hate the war but still support the soldier who risks their life for you. No matter which side you support...support the Soldier!  





My challenge to you is this:  Each and every time you see a Soldier tell them "thank you."  If you understand their sacrifice you will appreciate what they stand for.  

Today is Veteran's Day.  There have been many sacrifices for your right to have whatever opinion you may have.

The following is taken directly from:  United States Department of Veterans Affairs

In November 1919, President Wilson proclaimed November 11 as the first commemoration of Armistice Day with the following words: "To us in America, the reflections of Armistice Day will be filled with solemn pride in the heroism of those who died in the country’s service and with gratitude for the victory, both because of the thing from which it has freed us and because of the opportunity it has given America to show her sympathy with peace and justice in the councils of the nations…"
The original concept for the celebration was for a day observed with parades and public meetings and a brief suspension of business beginning at 11:00 a.m.
The United States Congress officially recognized the end of World War I when it passed a concurrent resolution on June 4, 1926, with these words:

  • Whereas the 11th of November 1918, marked the cessation of the most destructive, sanguinary, and far reaching war in human annals and the resumption by the people of the United States of peaceful relations with other nations, which we hope may never again be severed, and
  • Whereas it is fitting that the recurring anniversary of this date should be commemorated with thanksgiving and prayer and exercises designed to perpetuate peace through good will and mutual understanding between nations; and
  • Whereas the legislatures of twenty-seven of our States have already declared November 11 to be a legal holiday: Therefore be it Resolved by the Senate (the House of Representatives concurring), that the President of the United States is requested to issue a proclamation calling upon the officials to display the flag of the United States on all Government buildings on November 11 and inviting the people of the United States to observe the day in schools and churches, or other suitable places, with appropriate ceremonies of friendly relations with all other peoples.
An Act (52 Stat. 351; 5 U. S. Code, Sec. 87a) approved May 13, 1938, made the 11th of November in each year a legal holiday—a day to be dedicated to the cause of world peace and to be thereafter celebrated and known as "Armistice Day." Armistice Day was primarily a day set aside to honor veterans of World War I, but in 1954, after World War II had required the greatest mobilization of soldiers, sailors, Marines and airmen in the Nation’s history; after American forces had fought aggression in Korea, the 83rd Congress, at the urging of the veterans service organizations, amended the Act of 1938 by striking out the word "Armistice" and inserting in its place the word "Veterans." With the approval of this legislation (Public Law 380) on June 1, 1954, November 11th became a day to honor American veterans of all wars.
